Implications of Supreme Court Order on Atrocities Act

The Supreme Court’s 2018 ruling on the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, 1989 (PoA Act) has sparked widespread concern. By introducing mandatory preliminary inquiries before arrest and allowing anticipatory bail, the decision weakens key protections for SC and ST communities. The ruling, based on concerns over alleged misuse of the law, has been criticized for making it harder for victims of caste-based violence to seek justice. Many fear that these changes tilt the balance in favor of the accused, rather than protecting the vulnerable.

The PoA Act was originally designed to ensure swift action against caste-based atrocities. It mandated immediate arrest upon complaint and denied anticipatory bail to accused individuals to prevent intimidation of victims. The Supreme Court’s ruling, however, now requires police to conduct an inquiry before making an arrest and allows bail if the case appears weak. Critics argue this adds bureaucratic hurdles and discourages victims from coming forward.

The ruling cites concerns over false cases, pointing to high acquittal rates as evidence of misuse. However, studies show that many acquittals result from systemic biases—police inaction, social pressure on witnesses, and intimidation of victims—rather than false accusations. By overlooking these realities, the court’s decision risks emboldening perpetrators of caste violence.

The backlash was swift. Nationwide protests erupted, with activists and policymakers demanding a review. The government opposed the ruling, reaffirming that the PoA Act was meant to protect marginalized communities, not be diluted.
